Terms of Service

These Terms of Service (β€œTerms”) govern your access to and use of the VibeInk website at vibeink.com and all related services. By creating an account or placing an order, you agree to these Terms. If you do not agree, please do not use our services.

1. Eligibility

You must be at least 16 years old (or the age of majority in your jurisdiction) to use VibeInk. By using our services, you represent that you meet this requirement.

2. Services

VibeInk provides AI-generated logo designs printed on made-to-order merchandise (t-shirts, hoodies, mugs, etc.) through third-party print-on-demand providers. We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.

3. Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and complete information when creating an account.
  • You are responsible for all activities that occur under your account.
  • You agree to notify us immediately of any unauthorized use.

4. Orders, Pricing & Payment

  • All orders are subject to acceptance and availability.
  • Prices are displayed in your local currency where available (USD, EUR, GBP, CAD, AUD, INR, SGD, JPY, CNY).
  • Payment is processed securely via Stripe at the time of checkout.
  • All prices include applicable product taxes. Import duties and customs fees are the responsibility of the buyer for international shipments.
  • We reserve the right to correct pricing errors before order fulfillment.

5. Shipping & Delivery

Since all products are made-to-order, production typically takes 2–5 business days before shipping. Delivery times vary by region β€” see our Shipping Policy for details. VibeInk is not responsible for delays caused by customs processing or carrier issues.

6. Intellectual Property

AI-generated designs are provided under a personal-use license. When you purchase a product, you receive ownership of the physical item and a non-exclusive, non-transferable right to use the printed design for personal purposes.

  • You may not resell, redistribute, sublicense, or claim exclusive ownership of the underlying AI-generated artwork.
  • The VibeInk brand, website design, and platform technology remain our intellectual property.
  • If you believe your intellectual property rights have been infringed, please contact legal@vibeink.com.

7. Refunds & Returns

Our refund and return policies are outlined in our Refund & Returns Policy. Because products are custom-made, we handle returns on a case-by-case basis for damaged, defective, or incorrect items.

8. Prohibited Conduct

  • Using the service for unlawful purposes
  • Attempting to disrupt or compromise the platform's integrity
  • Creating accounts under false identities
  • Scraping, data mining, or automated access without permission
  • Circumventing security measures or access restrictions

9. Limitation of Liability

To the maximum extent permitted by applicable law, VibeInk and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law (including EU/UK consumer protection law).

10. Consumer Rights by Region

European Union & United Kingdom

EU and UK consumers have the right to cancel distance contracts within 14 days under the Consumer Rights Directive / Consumer Contracts Regulations 2013. Because our products are custom-made to your specifications, the statutory right of withdrawal does not apply once production has commenced (Article 16(c) of Directive 2011/83/EU). Defective goods are covered under local consumer warranty laws.

Australia

Australian consumer guarantees under the Australian Consumer Law (ACL) apply. Nothing in these Terms is intended to exclude, restrict, or modify consumer guarantees.

United States

US consumers are protected by the Federal Trade Commission Act and applicable state consumer protection laws. Our refund policy is designed to comply with these requirements.

Canada

Canadian consumers may have additional rights under provincial consumer protection statutes.

11. Governing Law & Disputes

These Terms are governed by the laws of England and Wales. EU consumers may also bring proceedings in the courts of their country of residence. For US consumers, disputes will be resolved through binding arbitration on an individual basis, unless prohibited by applicable law.

EU residents may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. Changes to These Terms

We may revise these Terms from time to time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before taking effect.
